Statute Barred or not HELP !

Im new to this and looking for help with a debt problem.

I received a letter from a debt collection agency Link Financial Outsourcing 02/04/2012.

The letter was a statement of account! totalling a balance of nearly £16000 with a starting balance of £8391.00.

According to the letter the debt dates back to 16/01/2006.

I looked on web site to see what I could do, so I sent the standard letter of Statued Barred as by my calculation the debt is over 6 years old.

The company then sent me a letter that they refute the claim as they issued legal proceeding against me on 06/12/2007 to recover the ballance and have secured a charge on my property.

They have enclosed a copy of the intermin and final charging order. But the date shown on this order is 25/03/2008

Can anyone help me with this situation??

    So how did they get a charging order on your property without you knowing about it? Do you recognise what the debt is for?

    If they have a CCJ, then it is not Statute Barred. Depending on why you were not alerted to the court action, you might be able to get the CCJ set aside. But the proceedings would have to be very defective to get the date of originally taking it to court overturned.

    Thanks for your reply.

    The debt was for a kitchen of which I did pay alot off over some years. However from memory it would seem they have reset the debt back to the total amount! Not accounting for what I pay.

    The company probably did send documentation but at that time I was going through a rough patch, with now my Ex. She had nothing to do with the loan.

    Can the company charge interest at what every they like for example £200.00 per month? Of which I had no clue untill the statement dropped through my letter box.

    I have never written or spoken to the company at any time.

    I very worried regarding my house, can they take it off me?
