A little help please with old ccjs and defaults?

Mornin all,


I've had/got some ccjs and defaults which I've been paying small amounts on for years and which no longer appear on my credit report, but recently been contacted by DCAs on 2 of the debts, demanding much larger monthly payments and threatening with court action.


So what I want to know is, can I be taken to court/defaulted more than once for the same debt and can these show on my credit report again?

    As you have been paying, the statute of limitations does not come into play. Once you have defaulted, that is it, you cannot be defaulted twice foe the same debt. If you have been hit with a CCJ, they cannot hit you with the same CCJ on your record, but they can apply for a 'redetermination' which can change the amount you must pay.

  • Thanks DVardys. So are DCAs powerless to instigate further action? If I can only pay £10 a month can they insist on more?

    It's not that I won't pay but don't want any more defaults etc on my credit file now that it's clean. :)

    yes, they will apply for a redetermind ccj i think its called, if successful they could up it to a high court writ if they being nasty and send the sheriffs round to enforce it by asset seizure

    they cant put another default etc on your credit files. :)
