Putting 90% of wages in pension to avoid CSA?

    My ex-wife tried this about 6 years ago, but put 100% of salary into pension (I think her mother supported her financially). I applied for a variation on diversion of income and won at tribunal where they disregarded the whole of her pension contributions (I was expecting them to allow, say 20%). She asked to appeal, which was turned down, and then appealed directly to the commisioner, but withdrew close to the date of the hearing so ended up with a nice large bill for the arrears, which she had to pay in one large lump.

    I think the point here is that it is seen as "a diversion of income" and nothing else...

    What would the scenario be then if the NRP was making the very same Pension payments before the split and subsequent claim...? I doubt very much they could see THAT as a diversion of income as it would of already been in place...

    Just a thought... ;)

    Good question, and it seems unlikely in the EXTREME that he would have been paying 90% of his income in pension contributions whilst he had dependent children living with him, doesn't it?
