Personal Injury Claim

Hi all,

Please can someone give me advice with regards to the following as we are just a bit puzzled?

My husband had an accident at work in 2010 and then shortly after started to pursue a personal injury claim with a no win no fee specialist injury lawyer company. They have had some fairly positive testimonials and recommendations from past clients etc..So we thought we would be in safe hands so to speak.

The claiming process was going quite well up until now. There now seems to be gaps in between where we don't hear back for weeks from his lawyer who is dealing with the claim. Their website states that they are dedicated to their clients and promises to keep them updated every two weeks regardless of developments or not.

We are now at the stage where my husband's lawyer is waiting for his second medical report to come back from the medical expert after having his first one back in 2011. (The second examination took place in March 2012.)
However, we were told by the medical experts organisation that the report was sent over to his lawyer(via email) on the 3rd April 2012. The second one was resent over again just in case he didn't pick up the first one. But his lawyer still insists that the report has not come through yet? He says he is still chasing it up from the organisation!

The third one has been sent over again today by the same lady who sent the first and second one! The lady doesn't seem to know what's going on. She is puzzled just as much as we are! I spoke to a different lawyer on the phone about this situation as his lawyer was unavailable and he doesn't seem to have a clue either?

Where on earth can we get a definitive answer?

Shall I write to the director of the company?

Has anyone got any suggestions or had similar experience like this?

    Hassle them on a daily basis, its amazing how fast they can work when someone is being a flaiming nuisance.

    I would love to do this and we do appreciate that these lawyers are bogged down with so many claims etc..but also appreciate that the claiming process can be a long one.

    Having said that it has now been two years since pursuing claim and to be fair to ourselves we have given the lawyer enough space to work on the claim and are not rushing it and allowing the claim to run its course naturally.

    However, I think we will speak to the director on Monday and see if he can throw any light on this.
  • I would say there is nothing new here!, they know you need them now and they can wait for their money!

    I would suggest that you find out who your solicitor's secretary is and liaise with him/her, making sure that the reports have been sent to the correct email addy/fax machine.
    These things seem to take forever. My barrister is finally meeting with the opposition next week, almost 8 years after my initial injury. My solicitor has never contacted me without a prompt during all that time and has often promised to call me back and not done so.
    Looking back, I wish I had been more of a nuisance - maybe I would have been kept better informed.
