incorrect default notice


Hi there,



My wife has found a default on here credit reportfrom a mobile phone company from 2009. She called them today to query it andthey admitted to her that it was incorrect as it should have been registeredagainst somebody with the same name who lives in another city altogether!



They have asked her to write to them to requestthey remove the default notice along with a copy of her credit report.



Has anyone had this before and got any advice onwhat to put in the letter?

Other than this default her report is clean asa whistle so it’s been good to fine this out!

    default for someone else on your credit report

    = breach of data protection act
    = defamation/libel


    say that unless they take the default off you will consider action againts them on boyth counts

    Dear sir

    Further to our recent telephone conversation, I request that you remove the default notice placed upon my credit file in error.
    I enclose a copy of the said credit file as requested.

    we wrote to the mobile phone company and requested confirmation in writing that they would be removing this entry on her credit file and would like it within 7 working days. This is over a month ago now with no reply and she phoned last week and nobobdy would tell her if it had been done. They were very rude and just told her to check her credit file and see if it had been removed. She explained that she has already paid for a credit report and used a free trial so would like an answer from T Mobile themselves. He told her to write to the credit refferal team as they do not take calls. does anybody have a sample letter i could send to them. they were no help at all considering it was their error!

    Send them a complaint, signed for, stating what you said above and that you want confirmation of the removal of the default and compensation fro your calls/admin costs (credit file checking/postage/time).

    Once you get a written reply, check your credit file a week later and if not removed send your complaint to the FOS.

    Dont deal with them on the phone as you have no proof of what hey said and they can say what they like and lose the recording should they wish (conveniently)

    I think you have to complain to the Communications Ombudsman not the FOS for mobile accounts?
