Sole trader isn't good ...has he been paying your tax and nat ins etc or do you do that yourself ?
If he does you need to check it has been done.
Is there any assets in the company (or anywhere else for that matter) if so you needt to try and talk him into transferring them to you for security.
The problem with a sole trader is they are vulnerable from creditors for the buisiness as well as private creditorsIt's not just about the money0 -
If he goes bankrupt your letter is worth as much as his banks, zippy. You will be liable for the debt, as the credit card company have not agreed to itDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Your boss sounds a scumbag.
Borrowing money he most likely knew he could never repay.
Not paying you your wages, as and when required besides what wages he already owes.
And taking advange of you.
I've no doubt when he asked for the loan he knew if he didn't repay you'd be stuffed.
I'd take this scumbag to small claims NOW.
Give him notice to repay what is owed within 28 days, a reasonable time, if he doesn't cough up ALL OF IT, get it in court.
As for your wages, it's simple, make him pay up or don't go into work tomorrow.
Finally, he's taking advange of your good nature, sounds like someone you shouldn't be working for let alone lending money too!!0 -
It will be a complete waste of time and money taking this man to the small claims court - he just won't pay and then the OP will have to go back again (and again); he will then ask for time to pay which the court will grant then, after all that he'll just go bankrupt.
OP - it's very important that if he hasn't done so, you make sure your tax and NI situation is sorted out, otherwise you could be in even more trouble. I also quite like the idea of your boss giving you equipment from the business to 'look after'.0 -
Why the uncertainty over what happens to the credit cards if he goes BR? That debt is in your name and you will owe it and the bank will care not what you spent it on or who for. The debt he owes you will become part of the BR and you will be a creditor.
If it were any other way, we would all be assigning our CC debt to each other on the off chance one of us went BR.
'Looking after' equipment will do no good if the business goes BR as the assets will be reclaimed I would have thought. The title needs to permanently change ie the equipment needs to be sold to the OP to pay off the debt.0 -

Years ago I had an issue with a company who had stopped paying my wages as they hit financial difficulties.
I called the CAB at that time (about 20 years ago) and they told me that I wasn't allowed to take my wages from the till, but that it was legal to take something from the company that would realistically repay the debt.
I don't know if that rule still stands, or if your boss has anything of value in the workplace that you can take to sell and repay the debts, but that may be something worth looking into if that option sounds like a possible solution for you.
