No default notice received

Hi there,

I'm looking for some help on removing a default that was put on my file from a mobile company and has been sold on.

After I moved house I found out that I was not receiving all my post to my previous address as my address was prefixed with "The Coach House" and most of my mail had been being delivered to a set of flats for approximately 2 years. I had no idea this was happening as I did occassionally receive the odd letter I guess depending on the postie.

At my new house I then received letters from the debt collecting agency asking me to repay a debt to the mobile company. On further investigation it appears that a default was applied to my file and that I probably do owe the amount.

I have no problem with paying the debt off as it is not a large amount but I am incensed that I now have a default on my account.
I have been in constant correspondence with the debt company for the last 12 months but they seem to refuse to budge on removal of the default which is now in their name.

Do I have any chance of getting this default removed?

    Slim to none as it accurately represents what happened, unfortunately you are responsible to ensure companies have your new and correct mailing address.

    They did have my correct address as I have received copies of the assignment with the correct address on it. The problem lies with the post being misdelivered.
    I actually had to go to court last year due to an unpaid speeding fine that I never received notice of and the court found in my favour.

    If you knew you owed the money for the phone, whether you moved on or not why didnt you chase it up when you werent getting the bills. You have no hope of getting this default removed I'm afraid. It is a true history of your credit. There would have been a few letters before the default notice sent out to you.

    As for the court, it is very strange, how did you go to court last year if you never received the notice, how did you know when and where to go. If you indeed didnt go, the court would not have found in your favour. Strange........

    I received a letter from a debt collectors at my new address regarding the speeding fine and it had been increased from 60 to 660 pounds for not showing up at court the first time. I contacted them regarding this explaining my situation and they organised a court hearing. I had to read a declaration and they removed the fines and stated it was up to the police if they wanted to get the original fine from me which they have not.

    I did not know I had money outstanding on the phone it was fully paid up as far as I was aware when I moved. As I stated no letters were received by me the only evidence the company have provided me is the assignment of debt letters.
