Payday Loan Claim??

Hi all,
I have had a torrid time over the last few years, mainly brought about by my ex wife. In the last throws in my relationship, she started draining us of our money, leaving me nothing to feed my children and me. I am now in financial hardship. During the course of this, in order to put food to mouth, i had to take out payday loans. Now reading the news on Payday loans possibly being claimable as they don't really check your suitability and financial position before giving you one, i was wondering if anyone has ever claimed charges and fees from these companies or if its worth me trying this as it would help massivly if i could.
Any opinions on this would be greatly appreciated.
Many Thanks

Surely you knew your financial position when you took out the loan?0

Exactly.
Did you pay them back on time?0 -
No i didn't pay them back on time but I couldn't as she had taken all the money. But also Yes i did know my situation at the time however, when you are desperate, you do things and stoop to a level never thought possible to ensure your kids are ok. But please, before i receive any type of lecture about this from anyone, i did what needed to be done to feed my children. Im not after a quick buck as i have paid my way all the way through life.0

@Mara69, Tbh im not after your respect. And i am not trotting the tired old lines when they are true. You do not know my history or the detailed situation i was in at the time so please keep comments like that to yourself until you know the facts please.
I am becoming rather annoyed now with the fact these boards are no longer filled with the helpful people we were all told about when i first joined, but now people who would rather jump all over the person who asked a simple question, brandishing them as liars or people who make out life is worse than it is, when they weren't the ones in that position. I was. So were my children. I know what happened. Nobody else was there. And i can almost catagorically guarantee that if i had been a single mother, i would have had help and support and "dear dear its ok, damned OH" There is enough proof on these boards to support that.
I suppose yes you could say im after a quick buck, but tbh when i have paid my own way all my life, and there are people out there who are claiming back PPI they did ask for in the first place and the such, i think i can be forgiven for trying everything i can to get out of the situation i am now in.
I understand people get upset when they see people trying to get what they aren't entitled too, and in the case of benefits and tax releif, i would agree 100%. All im trying to do is become debt free so i have money i can spend on my kiddies.
I dont mean to rant at people but please, instead of victimising people and making out they are in the wrong, please just try and answer the question. If you dont want to answer the question, please dont reply.0 -
Aston, I can't help with your particular problem, but felt the need to comment because I too came here for help and got a few rather smart a** remarks, its not big and its not clever. This site is supposed to be for help and when I first joined, I got some help from some really nice people, but recently its turned into a trolling site. Its a shame because that isn't what its supposed to be about but some people feel the need to poke those who are already in pretty awful situations. Sad little people with not much else to do. I hope your situation improves.0

You know your financial situation when approaching a payday loan company.
They know your situation as you have a approached them for a loan, if you werent desperate you wouldnt be knocking on their door.
They are allowed to charge fee's, the loans arent illegal, I dont see the problem.
The point of a payday loan is that you pay it back quickly.0 -

People are not going to fluff it up and pander to your needs when you are in the wrong. If you are in the right and have been ripped off, people on here will be helping you and giving good advice. You have got realise when you borrow money and you dont pay it back, you are responsible for this.
The only advice you can really have in this situation is that the payday loan company are not in the wrong, you need to learn from the mistake of taking these loans and move on.0 -
@Roonaldo,
I know exactly what you are saying and i have learnt from my mistakes, unfortunately learning from my mistakes hasn't made me debt free. Its getting there. All i was meerly saying was has anybody successfully claimed, not that i wanna sue people for every penny. I never said that once, but people have just been presumtuous and suggested that i have.
@Mangokitty,
I completely agree and thank you. I can see light at the end but its gonna take ages getting there. I am moving in october with somewhere with cheaper rent. About £300 cheaper, not including the cheaper bills. That including that my partner has just got a new £1200 p/m job means we should be well on our way to clearing them all. Im just impatient and there always seems to be a problem cropping. Like car breaking, tax, boiler breaking. Litterally a new problem every month which either puts back or halts our repayments. Grrr:mad:
However did just get £369.53 from MBNA for PPI. 2 more payday loans cleared now. Whoop Whoop!!0 -
To roonaldo's point I have been viewing these forums for a couple of years and I have noticed that more people seem to think they should be given money back when a company has done nothing wrong.
The responses I see that are considered unhelpful are usually just stating simple facts such as you knew what you were getting into so you cannot complain. One post I saw today had someone complaining that a company would not refund a legitimate fee.
However the people on MSE are always willing to provide help and support where an individual needs genuine help, such as when they have been mistreated / mis sold or they reach out for help with debt problems.0 -
Nothing. I was agreeing with what you said.0
