Car accident have a ccj 5 years after....Help please!!

Hiya,

New here so not sure this is even the right forum!

Basically November 07 I was pulling out of my parking spot and my car was a foot on to the road when a car I had seen at the top of the road in my mirror came whizzing down the road at approx 40 mph (in a 25 mph home zone) and smashed into my wing.

This was seen by 2 witnesses, she also admitted she shouldnt be on the road as she had just had an accident on the M1 - We swapped details and a week later I filled in a form my insurers sent me detailing what had happened, havnt heard anything since.

Moved out with my partner a year later but my parents still live at the address I had the accident, I have since changed insurers and have heard nothing about the accident at all untill I visited my parents house today....

I have 3 Letters:
One from a solicitor informing me I am being sued for the accident I had (named person wasnt even the driver at the time) that I am to pay full damage of 1,000 and th ecar was a write-off?? (wasnt at all my car was more damaged than her slight bump in the bumper) with a CCJ claim form attached....

One saying that the judgement has been passed against me and I am liable to pay 1,000 for her car plus 536.70 in court fees

One from another solicitor saying I have 14 days to pay CCJ before bailiffs attend my address.

Have got on to insurance who are useless but natwest have confirmed I was paying BDML Connect car insurance who I presume are/were the underwriters for HSBC (Who know nothing of my claim)

Just have no idea what to do as I havnt gotten any of the letters and surly insurance should have paid this anyway?! Although on 3rd letter it says my insurance company have been contacted and have not paid this or responded....

Can goods be removed from my parents even when I havnt lived there for 4 years?

Been googling all night but all I can find is threads on running away, from debt, but obviously in this case I had no one to inform as this isnt a creditor and I had no idea of it till today??

Thanks for any help in advance!!!!

    Hi there.

Don't worry too much, pass all the documents to your insureres at the time and make sure that they deal with it.

You have a CCJ now which can affect your ability to get credit so this needs to be dealt with.

The Claimant can also enfoce the CCJ but cannot take your parents property so don't worry about that.

You should be looking at getting the CCJ set aside, you have been taken to court without your knowledge, and by the looks of things this should have been the insurance company dealing with this. Others will offer better advice I am sure

Do you have legal assistance with any insurances you have? Or as a member of a union? It is sounding to me like a potential case of insurance fraud.
But a banker, engaged at enormous expense,
Had the whole of their cash in his care.

I agree you need legal advice on this, if you don't have legal cover with your insurance, don't know if a house legal cover would cover this
