my daughter is pregnant and was on the sick for 2 months ,her employer told her she was entitled to maternity pay,yesterday was her first pay for maternity and she received nothing .
On phoning her boss she was told she was not entitled and had to claim maternity allowance which they had put a form in the post for her, should they have let her know earlier as she could have signed on the sick for another 4 weeks to cover her with a bit of money,.
Do u know if she is entitled to her holidays and is the maternity allowance based on her full time wage or her sickpay wage?

To qualify for maternity allowance your daughter must firstly not be eligible for SMP. How long has she been at her employer? If they don't pay her SMP but she qualifies, she can sort it through the job centre. If she doesn't qualify for SMP, she may qualify for MA (also sorted through job centre).
To get SMP, she must have been employed continuously for 26 weeks before the 15th week before due date, and have been earning over £107 per week for that period.
For MA, she must have been employed for 26 weeks over the 66 prior to her due date. She must have also earned over £30 per week for 13 weeks over the 66 weeks prior to her due date. None of these weeks have to be consecutive and one day worked in a week is counted as a full week. The Standard amount is £135.40 or 90% of her weekly earnings, whatever is lower. This will be paid for 39 weeks. However it does depend on NI contributions having been made, so depending on wage earned, she may not get the full whack.
If she hasn't worked for them for 26 week before the 15th week before due date, but has done 26 weeks at varying places over 66 before due date, she can use whichever 13 weeks in that time will give her the highest average earnings.

hi - yes they shouldve let her know she was not entitled to it within 28 days of her handing in her mat b1.

yes she is still entitled to all holidays and bank holidays which she can add onto the end of her maternity leave, she can also take unpaid mat leave to take her up to the 52 weeks.0
