Nationwide CCJ help!

Hi, not posted in a while as all has been quiet on the DMP front... until now! I've been in DMP with Payplan for 16 months and at my review I upped payments from £101 to £120. Always paid on time. I owe £2300 approx on N'wide CC. They decided last Dec they wanted more than the £10.50 sorted out on DMP and offered f and f of £1500 or £50 a month. I rejected this as knew the moment the apple cart was upset on DMP ie one creditor suddenly getting more, then the plan would fall apart. They sent court papers and Payplan legal team returned them with my I & E and offering what I already pay on DMP.
Today I've got a CCJ for £85 a month instalments!! I'm going to ask for redetermination hearing but sods law, Payplan now shut until after Monday for advice!
Any advice? I'm worried as last month a got 10 months back pay of £120 plus earned £250 overtime but this isn't regular and in fact has all but stopped, so if I take recent bank statement, it looks like I'm lying about income. By the way, I spent extra on having dead and dangerous tree removed from garden, so not on luxuries!

Just explain that to the court and take previous wage slips showing normal income as proof.Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.0

Put the redetermination request in ASAP.

Hi Squirrel29
I was in the same position as you with Nationwide (or Nationsnide as I now call them ). However, because I am a house owner (with a mortgage), the judge went with Nationwide and not only issued a CCJ but went on to issue a Charging Order.
Nationwide are increasingly bullying their way to getting higher payments because they, for some reason, feel they are more deserving than other creditors - I have nothing for contempt for this so-called building society..DFW'er - Lightbulb moment : 31st July 2009 - £18,499

It sounds like you're on a dmp that will take nearly 20 years to complete. Are you sure you're on the right strategy?0

Well, given that my strategy is repay my debts with an amount I can afford each month.... erm , yes
At the moment, my dmp duration is about 16 years but I am looking to shorten that as my circumstances improve.
I personally do not agree with individual / personal bankrupcy as in my opinion is that it presents too easy an option for people to "run away" from their debts.DFW'er - Lightbulb moment : 31st July 2009 - £18,499

Hi fatbelly. It won't take 20 yrs as the plan is that when a secured loan of £173 ends in 3 yrs, that money will be added to the DMP payment. I have also increased my payments by £20 per month too and intend to do this whenever I can. I didn't want to take bankruptcy or IVA route as I feel I spent the money and should pay every last penny back.Second and final LBM 01/01/11 Nearly got there but fell of wagon. You're a homeowner. You'd need to be very careful about an insolvency option. That wasn't clear from your original post.0
