Statute barred scotland

My husband had finance on a car 12/13 years ago. He handed the car back under the terms of his finance agreement. The finance company sold the car and still wanted the full finance agreement payment (contrary to his agreement). We lost touch with the finance company ove the years, the last time we heard from them was about 6/7 years ago (or possibly longer I really don't remember) when I asked for a copy of the agreement as we did not agree the debt was owed but had lost the paperwork. We heard nothing else until today when the company who has bought the debt is threatening legal action. My issue is I don't understand the statute of limitations as applied in Scotland. I know it's called the prescription and limitation act but don't know how it's applied - any advice much appreciated. They have only ever spoken to me about it, never my husband and this agreement predates us meeting.

If your Husband has not made a payment, or acknowledged the debt in 5 years then under the act it is now S.B. Send them the S.B. letter you can find on any of the recognised debt advice charities websites.2012 Wins: 1 x Case of Lanson Champagne :beer:0

It is no longer legally enforceable, but they can still pester you regarding the debt, just do not acknowledge it in anyway shape or form, tell them you are aware of the Statute of limitations Act, and hopefully they will take the hint0
