    Just make sure its true and factual otherwise you are getting yourself into more trouble. Personally I would write refusing to give a reference...that in itself is daming enough

    The benefits office will write to you, the employer, to ask for the reasons for the dismissal and if they were to do with the employee's conduct then she will get sanctioned. The only reason I can think of to try and get sacked apart from erroneously believing you can claim benefits, is to get notice pay (which you would have to pay if it was not gross misconduct, although you are within your rights to ask for it to be worked the majority of the time it is too awkward to ask a sacked employer to stay on to work notice). Did you pay her notice pay?

    You made a critical mistake of sacking her. Should have enjoyed making her work so she's unable to take on her new job without paying you to dismiss her.

    If you had evidence that under performance was deliberate.

    Gross misconduct out same day or a few days.

    As long as you company does not have policies that require excesive time.

    She wouldnt have wanted to resign because her benefits would have been sanctioned. Probably doesnt realise that they can be sanctioned anyway, depending on the reason she was sacked.

    Only for new starts as of this April - for anyone who started before that - then it sticks with 1 year.

    I can believe it. For some they relish in creating such a horrible atmosphere moaning about how they hate their job and don't want to be there. Sometimes feel like saying 'well just f******* go, im not stopping you'. Actually getting fired, not sure if they think it'll happen, some people don't know how lucky they are. Lol, sorry for the rant, no advice just feel your pain. I'm a supervisor not an employer but still have to suffer the same unnecessary turmoil!!!

    Did she have any holiday accrued but not taken? You could make her take that during her notice period - as long as you give proper notice of the holiday.

    If she had taken more holiday than accrued to date of termination (expiry of the notice period), do your terms allow you to deduct the over-payment?
