Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

I kindof guessed, I was just interested in how or wether use of funds could be calculated in such circumstances (although Ive yet to see such an occurrence in 20 years of banking ;) )

Yes you can, also you must pay them what you took from them
Fair point but what if they had sold it to a 3rd party to collect, and they also cannot provide the CCA?

    Yes.

Plus interest on the amount paid at 2 x the loan APR.

In addition, the loan company have to provide you with a hooker every Friday night for the next two years and a free car valet every fortnight until Christmas

    Mature, something I'd expect from a 14 year old!

Only asking because I'm having bother trying to get PPI back from what I paid of my loan, The lender have stated there is no record of me on their system, the 3rd party say they should have the CCA but dont, and yet persist on asking me to pay the rest of the loan I had. So I want to know just where I stand, legally if there is no CCA to reclaim my mis-sold PPI(which is needed now as they claim to have no record of me), then how can they justify forcing me to pay? And again if there is no CCA then can I reclaim the monies I have paid to the third party?:(
