Basically £13,000/260 = £50 per day.
NMW is £6.08, so £50/6.08 = 8 hrs 13 minutes. Anything less than a 50 minute break, and it's illegal.
IME when she's done work before, they've had a 30 minute break.
1 hr would be quite a long break
I'm not sure if it's the agency or the hotel to blame tbh, all recruitment agents are scum IME.0 -
You seem to be making an awful lot of assumptions about the legality or illegality of a job based on a piece of paper, no further information, and it being your wife's business anyway. No it doesn't sound very well paid, but as far as I know being a chef, unless you are one of the very fortunate few, isn't well paid. I would suggest that before you decide to apportion blame for who is breaking the law that you ascertain (a) that someone is and (b) that if they are your wife decide what she wishes to do or not do about it.0

To clear this up, I would ask the agency what the hourly rate was and then take it from there.
If they are not prepared to pay the NMW, which is the law it doesnt bode well for them really does it?0 -

If it is fair the tips should be split across the board because frankly if the food was crap the wait staff would get no tips.The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

I am neither, thank you for enquiring. But I no more interfere with my husbands business than he interferes with mine. We are both adults and quite capable of sorting out our own employment issues. I would be horrified if my husband posted my employment concerns on a public website - I am quite capable of asking either my agency or my potential employer the question.
