Mortgage fraud ???

Have a joint mortgage but going through a separation.

Have just discovered that my spouse has taken out a £10000 extension to the mortgage without my knowledge. Money has disappeared !!!!

Building society say they have a record stating that they spoke to me for my approval however this was not the case.

What can be done ? The building society are not being very helpful at all.

Do they record the phone conversations ? Can the paper trail of the transactions be followed ?

    I suggest a complaint to the lender in the first instance and then on to FOS if necessary.

    You might find that you have to get a crime reference number from your prtner/ex which in turn could potentially put him in prison.

    But at first i would speak to a manager at the building society and see what they suggest - if the branch is local maybe call in?

    What has your solicitor advised?

    What do you expect your lender to do? As you need to prove your case.

    I think the lender needs to prove theirs.

    Absolutely, lender will have to prove that you gave consent. The further advance process is very lax and they will almost certainly have assumed joint consent when speaking to only one partner.

    From what they say they spoke to me and i answered the security questions !!!

    Most definitely didnt. I think she got a stand in to speak on my behalf !!!
