Applying for a departure (cs1)-how long does it take?

We all know how long the CSA can take to complete their assesments lol but when they've finished this one I'll be needing to apply for a departure on the grounds that the ex's 'girlfriend' can contribute to the house they don't need.

How long do they take to sort that and how simple is it?All I've been told so far is that the CSA will give me a phone number to call to request one when they've finished with the reassesment (whenever that will be!).

The guy I talked to after the ex rang to inform them of change of circumstances and request reassesment based upon them asked,at that point,if they would like me to take her pay into account and I said yes,they have asked for her details anyway,but the woman I've now talked to said they won't use her details unless I phone after the assesment and request a departure?Not sure why they bothered getting her details already if that is the case lol

Also,should it be needed (wouldn't be surprised) what do you do about lifestyle not being consistent with income?

    They can ask but she has no obligation under the law to provide them!

    Please remember that it is only your word to the CSA that they don't need the house.

    Also if his new partner is a millionaire, it matters not, they can only take his money! They can't touch anything that is hers and is in her name!

    Ok,I'm aware of that but none of that was the question...........

    (and they don't need the house just choose it lol and the fact they don't need it is naff all to do with the csa anyway)

  • With a departure, they will take his partners income into consideration (they obviously dont take money off her) as she will help by paying towards household bills,rent etc so that will free up more of the NRP income to be used in the assessment. If he doesnt provide the NRPP income they will do a IMA.

    Yeah,I know they'll look at that.I'm just wondering on timescales as I hate all the faffing around with every aspect of mine and my sons life that has been caused by him being with her tbh!

    They requested her details anyway,but the lady I talked to today stated that even so,I will still need to apply for a departure after the assesment has been done (and that's going to take longer given them asking for further information from him).I don't understand them requesting it in the first place and then not using it until I ask for a departure after they've assessed...

    Just more faffing around *sighs*

    Not so bad then!Do they backdate it to the date of requesting it?Doesn't seem like too much faffing then which is something :)

  • They backdated it for me :o its normally from the date of the assessment in question

    Ah,ok.So they calculate,give you the figure,you request departure then they take a few weeks to sort it and recalculate to the beginning of that reassesment again..never simple is it:rotfl:

    Did they request nrpps details before you requested the departure?That's what I don't get,why ask me if I want it taken into consideration before they get the forms out,get her details and then say I have to phone a different number to apply for it after a calculation on his pay?

    They may be irritating and seem backwards lol but at least they're sorting it I guess!Could be worse

    He then has the right of appeal against an IMA and if there is no history of his new partner giving this it will probably be upheld and the situation will revert to what it is now! You will then have to repay any and all of the new assessment to him or more likely just get less till it is sorted out!

    On CSA 1 the max is 40% if there are arrears and if not then 30%.
