Mortgage Payment Problems

Hi, I was wondering if anyone could help me.
My ex has moved out leaving me to pay the joint mortgage on my own, she is refusing to pay anything towards it. We have had an offer on the house which we accepted but the transaction has been delayed due to subsidence, we are covered by insurance but excess is £1,000, again my ex is refusing to pay towards this. What are the chances of me calling the mortgage company (Accord) and asking for a 3 or 4 month payment break on the mortgage while I sort out the subsidence because I simply cannot afford the mortgage on my own, let alone this and the excess? We have about £40k equity in the house. Also will I be able to reclaim all of the mortgage payments I have made on my own on the house from my ex (or at least half of them) By the way I have the added problem that I transfered around £3k of my exs debts onto my creditcard before we split up, she said she would pay me back from the sale of the house proceeds, but it I go down the reclaiming the mortgage payments I am worried she will go back on her word on this.
I realise there are a lot of questions her but any help would be greatly appreciated.

You will need legal advice, but to be honest the cost of this may mitigate the motivation to undertake this.
I think you need to try and come to terms with your Ex over this and the credit cards, otherwise the £40k will be eaten up quickly.
I fear Accord are unlikely to give you a payment holiday although this is just my opinion as not seen this with Accord. They may be able to jump you onto interest only or increase the term in order to reduce payments slightly.
And what is your luck like with the valuation and subsidence. Only positive news is that you have a buyer and your Ex has agreed to sell - read this forum and you will see people that are existing in pergatory for many a reason..
Do what you can to get your money back, but spend your energy moving on with your life..
