personal injury reassurance

hi everyone
firstly thanks two the people i pmd
i rang the or office this morn to check on a personal injury claim.
she asked if it was pain and suffering which it is. there is £35 that was medicine and something else. she is contacting the solicitors to check which is fair enough but did say because its not as straight forward as pain and suffering. my claim was just pain and suffering minus the £35.
can someone put my mind at rest as im a worrier anyway and now will just sit here with it on my mind :( living on benefits this money would really help me,also being the way iam im worrying ive done something wrong. even though im sure i havent.
just need some reassurance and hugs if there are any spare?
2 months till dishcharge and very stressed

    I haven't seen your initial post so no idea what this is all about but just read this post and wanted to send you a virtual hug, I'm here with a cuppa, just trying to wake up.

    Try not to worry (easier said than done, I know) someone will be here soon who knows your situation. There is always someone here to give a hug when needed.

    basically i had traffic accident in oct and they are about to pay out a small compensation. i rang or as i knew it was the right thing to do but being alone it was scary :(
    im such a worrier and doing this all alone is horrible :(:(

    As far as I am aware personal injury compensation is not taken into account in a bankruptcy, just as it is not taxed etc. Personal injury compensation is just that, money you are entitled to for pain, suffering and sundry losses that have occurred through no fault of yourself. That money will be yours and yours alone and as far as I am aware the OR will not be able to touch it.

    Its a very speedy settlement if your accident was only in October, with the correct legal representation a claim would normally take more time than this. Are you confident that it is the right time to settle and a fair settlement is being offered? bare in mind personal injury claims are settled on a 'full and final' basis, which means once you have accepted settlement, you cannot go back and re-open the claim if further injuries/trauma comes to light. Is what they are offering fair in your opinion? be sure before you accept their offer. A defendants first offer is usually a LOT less than the claim is worth or what they would be prepared to pay following negotiations.

    yep its fine , loosing my pride and joy at the time was far worse than my injuries . only minor injuries and my depression was made worse by an un insured !!! who then disputed liability even after hitting me behind. i spose its stressful as i now sit here waiting and you feel like the or is investigating you again.

    Sorry you lost your pride and joy, I fully understand that feeling. Our cars can mean a lot to us. Uninsured drivers are evil and should be jailed in my opinion, they injure and kill. I hate them. Glad the worst that happened was losing your car, it could have been a lot worse, try to take comfort from that. Most guilty people deny liability, its enough to make you very cynical about mankind, it really is. Hope it all works out for you and try to do something nice for yourself with that bit of compensation you are so rightly getting. You deserve it, all the best honey xx

    If it was for pain and suffering, then it should be fine.

    The only time that could be claimed is if it "changed character" while you are undischarged.

    e.g. you used the money to by an asset/property etc that in itself would be claimable as an after acquired property.

    So if you use the compo money for day to day stuff then it should be fine.

    it is in my bank account and ive been asked to put it aside until theyve decided.
    it will be used for me to live thats all apart from i may take a small weekend away seing my hero. that will cost about £200
