Haven't been on here for a while but hope someone can help.
3 years ago I requested the credit agreement from a DCA, the letter I sent them was from a template on here. they never sent me the credit agreement, I then sent them the failure to produce agreement letter, again the template from here, and I stopped any further payments.
Saturday I received a letter from 1st credit regarding the debt, the letter was quite nasty, they said they have made numerous attempts to discuss the loan with me, but this is the first letter I have received from them, also in the letter they inform me they have transferred the account to a debt collection agency, well today I received a letter from mackenzie hall, again in their letter they say despite repeated requests for payment the account remains outstanding, and that they advise their client to take further action, mackenzie hall is not the DCA I sent the letter requesting the credit agreement 3 years ago.
what do I do, I don't want to ring them, should I write?

link on this may give you information on mackenzie hall, l would not trust them far as l can throw them.. as the first person who pursuing the debt, they not responded failing a CCA which you have stated.. l am not sure what you can do... good luck0 -
As I understand it, the account is now owned by 1st Credit, and they are employing Mackenzie Hall as a collector. MH are independent AFAIK.
There is no need to involve any organisation other than these two.
The debt (I assume this is a credit card or loan) was subject to a s78 request 3 years ago which has not been complied with. Edit: I checked your thread from 2009 and you sent it to Connaught Collections. This IS part of 1st credit so they are (or should be) aware they have never complied.
Thus any attempt at court action could be stayed until they comply.
It is not difficult to comply if they wanted to.
Options are in two camps:
1. Blank them. They've got 3 years left to commence action. You've got a defence if they do.
2. Engage with them. Come to some arrangement.
Really what's best here depends on info we don't have. Edit: I'd incline to option 1!0 -

Thanks fatbelly for your reply, I did send them a letter before I saw your reply, (I posted a new thread tonight) but in the letter I sent MH I offered to pay £25 a month, I assume it's too late now to go for option 1?

it might be worth finding out if mackhall own the debt or are working on behalf of say "cabot" and then refer to the owner of the account. Mackhall have been utter clowns with one of my debts but after sepaking to cabot I got them to take back the account from Makenziespall and settled for a decreased price. remember, if 2 dca's dealing with the account they take comission on a pro-rate so effectively you are paying alot to the DCA.0

Hi, new here, and seeking some clarification as to the antics of this Mackenzie Hall company. I've had 2 calls from them. Yesterday I missed a call and no message was left. Today another call, but with a message. Both calls came from an "unavailable/Out of area" number.
The message left today babbled on about being urgent, quoting some reference nunber. I don't believe they even referenced my name, but it was hard to tell as the message was left at about 100mph. This got my suspicions up immediately - telemarketing I thought.
I've done some searching and can't find anything good about these people, and given I am 100% debt free (apart from my current CC balance which is paid every month) I don't understand why they are trying to reach me. I am ex-directory, and I've been the only occupier at my address.
I shall be completely ignoring them, but am puzzled how they have got my number and are calling me - do they use a random number generator for calling maybe?0 -
If your ex-directory number has been put on ANY applications ever, they can get it that way. All the banks share information with National Hunter http://www.nhunter.co.uk/ and most DCA's use this company when tracing people, although they'll never admit it.
So what I suspect has happened is that someone with a similar name has a debt, they've found a long list of telephone numbers for people with the same name and they've started dialling them.0 -
I need more help please,
I didn't complete the I&E form they sent me, but I made a first payment of £25 which I said I would pay.
They have sent me another letter headed Meritforce, saying an authorised collector may make a visit to my property, the letter has the same address as Mackenzie hall and it says if I do not want their collector to call and would rather arrange settlement I should call their clients Mackenzie hall, then they give me a name to ask for, which is the same name who signed the Meritforce letter!!!!
I really don't want to ring them, but I will send out a letter tomorrow informing them I wrote and said I would pay £25 a month, (obviously the first payment wasn't quick enough for them).
Can I ask them to request from their clients the credit agreement that I requested 3 years ago and never recieved?
