Good morning all,
I was made bankrupt in 2003. 2 months ago a collection agency acting for a creditor sent me a letter asking for payment, i phoned these people and told them about the bankruptcy and also told the creditors themselves and both told me ' ok, many thanks for the information, we won't be bothering you again'...even the credior was amazed i was being chased for this after 10 years, i had been wiped from their system !
On friday I received another letter from the collection agency, again I phoned them, spoke to a very rude man who told me I was lying about the bankruptcy and that the bailiffs would be round the end of the first week of May unless I can send them proof of the bankruptcy !! I have lost the copy of my bankruptcy order, just spoken to the Official Receivers who cannot provide me with a copy as it was so long ago and the papers have been destroyed !!!! I can see my details of the bankruptcy when I get on the London Gazzette website.....really don't know what to do, not sleeping and sick with worry !! any help would be most appreciated, many thanks

1st of all, don't believe the bullcrap that debt collectors come out with over the phone.
You could get a copy of the bankruptcy order from the court, but it could cost up to £70 so I would avoid doing that if you can.
The bankruptcy is a matter of public record in the gazette, so I would print out the entry and use that. Any debt collector can look that up themselves, so none ever has an excuse for making demands once you've told them of the bankruptcy.

i was declared bankrupt in 2005. in 2011 i started to get letters from DCA's regarding debts that were included in the bankruptcy.
i just wrote a letter, recorded of course, telling that i was declated bankrupt in september 2005, gave them the bankruptcy number and the court it was heard at.
never heard another word.0 -

What really gets my goat is, none of us should actually HAVE to do all this!
If DCA's did their own jobs properly, on acquisition of any account 'apparently' in debt, then this simple course of action should be one of the very first things they should be doing.
Not leaving it to [frightened?} discharged BR's to provide them with the information!
From my viewpoint, I may....note , may, disclose the information that the account was subject to a bankruptcy Order, and might...note, might just give the year of BR...if....note, if, the caller is incredibly polite about it all.
I would also tell them...if they seek further proof, that any BR is a matter of Public Record, either via the Gazette.....or...seeing as a DCA is part of the financial industry, a quick enquiry via Experian?
Any other time, I will refuse to co-operate one iota..and doubtless would encourage the DCA concerned to proceed to Court.
The only time I would be willing to disclose and provide BR information [ie, do their dirty work for them] is in a Courtroom!
And nowhere else.
It really is about time BR's ceased to be seen as underdogs! No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
Am I missing something here? These debts are over 6 years old - regardless of the bankruptcy do the DCA's have any powers whatsoever?0
