Sygma threatening attatchment order?

Just before Christmas I became out of work so went to the CAB to offer what I could to my creditors. All acceped drastic reductions for my payments exept Sygma bank who appointed a solicitor, who sent me a letter telling me they are going to turn the unsecured loan into a secured loan, take me to court and apply an attatchment to the house that me and my father own jointly!. Yesterday their solicitor rang me verbally warned me if I dont pay up or make huge monthly offers ( which I can't) they will make this a reallity!. What do I do now?, go back to the CAB?, or send a letter to Sygma or their solicitors?. Are they trying bullying tactics?.

I have just found out that they did not accept the payment plan!. I'm doing my best to try and sort out this at the moment which I see as a temporary measure!. Is this normal to jump in and do this in such a short space of time?..0

companys DO NOT have to accept a DMP plan, and yes the time scale is not too long because companys, like the rest of us are skint and need to recover money owing to suvive- not to go out of buisness and make people unemployed0

They can't make an unsecured loan a secured loan (I believe) , otherwise all the lenders would do it when you default. Also I don't think they can get an attachment to the house either, they can take you to court and get a CCJ against you, but the court will order what you realistically can afford. Don't ever deal with these people over the phone, send them a letter explaining your situation and ask for reduced payments , there are some samples here for you.

They can apply for a CCJ and have a charging order against your house. In reality this means nothing as long as you make the payments that are set in court. As the house is in joint names it makes it even harder for them - there is a thread about "Charging Order - The Myth" or something similar. Look at that for more details.0

i can help with this one i think, i have been down this road with sygma myself recently is the solicitor by any chance drydens?
they will not accept a small payment offer that i can vouch for, they will go to court and get a ccj. i sent in the form back to court with a statement of affairs clearly showing i could afford no more then 50 a month the court letter/ccj came back with a monthly payment of 234 as it said sygma/drydens had not agreed to the amount offered. i eventually after much research simply left them to go back to court to obtain a charging order. our home is jointly owned and the debt only in my name so in esscence its a restriction not a full charging order. this was the end of the road really for them at this point as the amount owed was relitivley small £1200 and they would never have got a order for sale for that amount. so once this was in place they wrote to tell me i still owed the money and what was i offering by way of payment if anything i offerd 30 quid a month and they accepted straight away.
check that the amount they have on the forms is actually the correct amount as my ccj was set aside three times until they finally got the correct amount owed on the judgement!!self confessed 80's throwback:D

That is a great help as I have been really worried about this. Yes it is the same solicitors. The situation is slightly different because the forms were submitted to the court through the cab with an offer. They then sent me a letter saying that i had not submitted any form to them and asked for the full amount. That was Tuesday of this week and today they have sent me a letter saying they have now passed it over to Bradford court for enforcement!. What does tis mean?. I have been back to the cab but cant see them for three weeks!. The question is where do I go from here?:eek:0
