CSA Case Closure

Hi,

I have been assessed on a CS1 (1993 scheme) for many years and have always happily paid the assessed amount and for a long time extras to.

I have now received a letter saying that my case is closed! This seems wrong on two levels as I should pay something towards the upkeep of my child that does not live with me but equally I believe the PWC has closed it in order to open a new case in 13 weeks time which would be on the CS2 (2003) scheme.

Due to being the PWC of children from a much later relationship i recieve tax credits which will be taken into account in CS2 and give her a higher assessment. All be it after not getting anything in the mean time.

As I understand it I need to apply to open a case with the same children and PWC details as the closed case within the 13 week window in order for it to be assessed on the old rules as previously.

Please could someone advise how to do this and where to find the forms required to do so as searching the internet and ringing the CSA have not really got me anywhere.

    Are you sure you won't be better off on CSA 2? Have you done all the sums?

    Yes. Done all the sums.

    Allowance for children living with me is much lower under CS2 and they take the CTC paid for their benefit into account as my income which they don't in CS1.

    At one time I would have been far better off under CS2 but not now.

    I don't know if this is true - as far as I'm aware when an old rules case has closed neither party can open a new case for 13 weeks. I've not heard of anyone being able to open a case case on Old Rules now.

    I've never heard of the nrp reopening a case that's been closed to keep it on the old system tbh.That's why many pwcs have it suggested to close case to put on the new system when payments are reduced.

    Just to add,from what I've just read WTC and CTC are taken into consideration on CS1.CTC will go under protected income but is fully disregarded in exempt income.

    Not that that means anything to me,I haven't got a clue:rotfl:

    I've also just noticed that they take the childcare element into the calculations on both too!Wasn't aware of that.

  • I think cases like this show that the NRP *isn't* always better off financially on CS2 - something that is often forgotten on this board.
