How long before a credit card company defaults you?

I have had over 100k of debt and numerous after PTSD, a failed marriage and lost a very nice home. Please be nice and not judge me on this.

When I returned from Iraq in 2003 I found out my wife had racked up serious debts. Once the house was sold to pay off debts we parted company.

I moved away and slowly and surely paid off nearly all debts however 1 debt still haunts me.

A credit card taken out 2001 and wasn't paid by me from November 2003 to 2006 when I started paying this again was entered into a payment arrangement which subsequently lapsed and was defaulted June 2010.

My credit file now all cleared has this 1 default until June 2016. I do pay every month since finding a new job but am wondering shouldn't lloyds have defaulted this earlier when I didn't pay for almost 3 years thus the default would be off my file although I continue to pay not affect me for credit still?

    Should have been defaulted within 6 months of non payment. Google 'ICO default guidelines'. Sorry I don't have the link at the moment.

    Who owns the debt now? I would send a formal complaint to them, in writing, signed for. After 8 weeks of not sorting the issue you can take further action via the Financial services ombudsman.

  • Thanks and I hope that works. Although I still have 4k to pay I am paying money to them every month but if was defaulted after 6 months this would mean I defaults on my credit reports hence a perfect credit rating

    Debt collection agencies have been known to change default dates. Who reported the default on your credit report?

    Ah ok. In that case. The complaints process should be easier :). Quote whatever you need to from the ICO default guidelines when complaining and come back on here if you need any help.

  • Thanks happy bunny was expecting the usual bed remarks although your response is great. Only question though is I didnt pay for 18 months + busy burying my head in the sand, although the ico guidelines show they should of defaulted it after 6 months as I wasn't secured debt, I hope by me doing an arrangement to pay doesn't change things

    Arrangements should not put you in a worse position than if you had never paid. I do a lot of reading on here. They are wrong from what you say.

    Debt Free Wannabe board is usually much friendlier than some of the others :)

  • I had wondered as most debt to be honest apart from first direct was with lloyds for a car loan via black horse and an overdraft but they disappeared off my credit file a year or 2 ago and are now paid in full. I will type out a letter to lloyds Tsb on Monday and send it recorded. Am I also check my credit files online with experian, call credit and equifax I may raise a complaint with them quoting the ico guidelines on defaults also as they will also context lloyds Tsb in relation to it as I have done it before for similar issues

    I would check the CRAs as you say. Wouldn't do any harm to dispute the date with them also if you have the time.
