Please Advise - Moorcroft, I'm scared!

Hi All,

I have fallen behind with payments on a loan with Natwest which I am in the process of dealing with, I am waiting for them to accept an offer of payment and a response to recent communication.

This morning I have received a letter from Moorcroft stating that I have defaulted on the agreement that I reached with them of £120 per month and I am now in arrears. I have never even spoken to Moorcroft and agreed any payment plan and the £120 a month that they seem to think I have agreed is more than the original payment on the loan so I wouldn't be able to manage this.

In their letter it says that if I don't pay this amount by the 25th April they will send a representative to my house within the next few days. I'm really scared now as I am home alone most days with my two babies and really don't want someone turning up on the doorstep.

Can anyone offer any advice as I really don't want to phone them if I can help it because I'm sure they are not particularly nice people and I know that they will end up forcing me into agreeing a payment that I can't manage.

    Moorcroft can't do anything! They are verbal bullys!

    They have to go to court before they can physically do anything so stop worrying! There are lots of threads regarding these ...

    Send this to Moorcroft by recorded delivery, do not phone them:-

    Dear Sirs,

    Account No: XXXXXXXX

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    I had the same letter off Moorcroft I rang them and went through my income, expenditure etc and we came to a monthly payment. They are not scary like some people have said they are I found them very helpful.

    The £120 is probably the arrears not the monthly payment.
