Hi
I am looking for some advice.
I have left the matrimonial home and am separated from my wife and child. I have moved into a flat and am paying rent. My wife refuses to sell the house. How am I expected to pay both rent and mortgage? What should I do in the short-term?

Move back in?
Act like grown ups for a few months so that your child is not affected with money being wasted on rent. I presume there is a spare bedroom?

Unfortunately "grown up behaviour" is not an option with her! She continues to assault me in front of my child when I drop her off after seeing her for the day. She asked me to leave the family home. Divorce proceedings have commenced.0 -

Two things spring to mind
1) is the mortgage in both of your names (if only yours, then surely she has no say in the selling)
2) speak to a solicitor (if divorce proceedings have already commenced, why have you not discussed this with a solicitor already)?
If you haven't yet sought legal advise, do so immediately (you used to be able to get a free 30 minute consultation), otherwise, how do you plan on defending (probably the wrong choice of word) yourself?

Mortgage in both our names but I have always paid it
Have appointment with solicitor to talk about way forward and submit Form E next week
Have not defended but took it on the chin - literally several times! Have not arranged to see my child since Easter as dont want to cause further upset!
Am in tenancy agreement for 6 months now and sharing with friend0
