you are the occupier (or you will be when the deed comes into force), so your names go on the left and right hand side.

    Witness needs to be independant.

What this deed actually does is give the Abbey the authority to take the house as security for the mortgage and any other loan you may take with the Abbey.

This consent is usually for occupiers of the property who are not party to the mortgage (children aged over 18 or aged parents living with you for example) but without seeing the whole form it is difficult to say. Many mortgagees send a separate consent to non-party occupiers which have to be witnessed by a solicitor who has to sign to say they have advised the occupier of their rights. I suspect therefore that this does particular document does refer to you, but you need to double check.

I am pretty sure the occupier consent relates to anyone else over the age of 18 who is going to live in the property with you.

You sign in the borrower part (as you have understood) so there would be no need to fill in the occupier part but you should check with your solicitor to make sure.

Are there any instructions with the form on how to complete each section?
