what is the minimum wage?

Hi, my sister has started work at Carphone warehouse recently, she is 25 and is doing really well! she has already been awarded salesperson of the week etc.... when 6 of the staff have been there longer

anyway whilst recently looking into her wages she has just realised that she is only on around £3.80 (or £4) an hour! surely this is illegal? I thought the minimum wage was around £5.50

Please can anyone offer advice!?

She needs to speak to her payroll as it could be a mistake that they've not noticed.

    National minimum wage helpline

If a worker wants to find out if they are eligible to claim the NMW they can contact the National Minimum Wage Helpline on tel: 0845 600 0678, minicom no: 0845 915 3296 (local rates apply), or the Northern Ireland Helpline on tel: 0845 650 0207. They can also use the Tailored Interactive Guidance on Employment Rights (TIGER) website at

    https://www.tiger.gov.uk

If you think you are entitled to the national minimum wage and are not receiving it you should contact the NMW helpline (see above) or seek the help of an experienced adviser, for example, at a Citizens Advice Bureau.

she is on a basic and does get commision on everything she sales but as there was no room on a training course she doesn't have her own number for earning commision so all the stuff she has worked hard selling she just get basic! that shouldn't matter though! she should be on at least min wage basic

She should be on £5.35 an hour. The website above should give her an idea of what to say to her employers.

  • Peanut - I am sorry to say that she doesn't necessarily have the right to be on minimum wage as basic. If other regular payments take her over the minimum wage, those can be taken into account. However, you are totally right that whilst she is not earning commission, her employer must make up the differerence between her basic and minimum wage.

I suspect, in all honesty, that it's a c*** up by payroll. If most people are earning commission that takes them over minimum wage, they have probably just been daft enough not to realise that she is currently falling below it. Tractically, I would suggest that she speaks direct to someone in management in a 'I'm sure that this must all just be a silly mistake' kind of way, as that puts them in the best frame of mind to fix it quickly.
