Thanks for the advice.
We did only have a valuation survey, although one of the questions is 'Is the room habitable?' which has been ticked as yes. If no window makes a room unhabitable am I right in thinking this shouldn't have been ticked and therfore a mortgage not given.
Valuation survey is done for the lender not buyer and in reality is to provide the lender with information to support whether the property is worth what it is being sold at. Therefore only the lender could really sue the surveyor not you. I can only really see you going against the EA who sold the property as they should have known that a room without a window could not be sold as a bedroom. Not sure you would get very far though.0 -

The EA who sold us the flat has gone bust!!!! Should have known there was something dodgy when he went out of business soon after buying the flat through him!

Can you overpay the mortgage for a few years to get you out of negative equity and sell at a later date? The lenders criteria may change again?December 11 2012 balances
