Just on the off chance - does anybody in here have a knowledge of employment law, how it works re part-time workers who are off sick long term? My DIL is a p/t clerical worker in the NHS and is currently off sick and will need a spinal op, so might be off a while yet. She doesnt know the terms of her contract re sick pay and doesnt want to call in and ask. We know that full time workers get paid for 6 months then half pay for 6 months - but how does it work re part timers??

I worked as a Midwife for the NHS and am now retired. I was on long term sick prior to this. It does depend on how long she has worked for them but not the hours. If she has worked for them for say 10 years she will have six months full pay and six months half pay. It goes down on a scale according to length of time served. The NHS have a very fair policy as regards sick leave which will involve meetings with managers and occupational health. If she is a member of a union she should seek representation and if not she can have a work colleague attend these meetings with her. Try not to worry but easier said than done once you are out the other side of it.I must not fear. Fear is the mind-killer.

Hi Mar, as Molly says it is the same rule for part-time workers, just pro rata, so duration of payment will depend on how long your DIL has worked for the NHS.
Remember (not that it amounts to much) but once entitlement to SSP finishes you can claim ESA for the remainder of your time off work

And you can claim ESA and be paid occupational sick pay from NHS once the SSP has run out (they send you a form after 28weeks).I must not fear. Fear is the mind-killer.

I was a TA, and was off sick with my MS. I only worked 16 hours a week, but got full pay for six months, then half pay for six months. I was then medically retired (which took a few months). I got my full pension straight away, and now get DLA and ESA as well. Hope this helps.I Believe in saving money!!!:T

She should also ask to be referred to Occupational Health (if she hasn't been already), or she should be able to self-refer. They will ensure that once the surgery is over she will be given any necessary support, adjustments or phased return that may be advised by her consultant.0
