Welcome Finance - HP Agreement Invalid?

Hi,

When we had no choice we took out an HP agreement with these guys for a car about 19 months ago. We are having difficulty keeping up the payments. Hubby was out of work for 12 months and the PPI did not pay up which has put us in arrears as we only made half payments for about 6 months.

My main query is this: when we signed up the agreement my hubby was in full-time employment but he was in his probationery period & he lost his job before the end of the period. At the time the broker knew that he was only on probationery but we kept our fingers crossed that it would be ok as we were desperate for a car (the broker had to fax hubby's contract through to Welcome for their perusal).

I am now wondering whether the fact that he wasn't in proper "permanent" employment will render that contract/agreement invalid? And if so, what will be the consequences.

Also how quickly can a Court Order be obtained (in case they get one as we have paid over the third).

    Not sure it would be invalid unless it specifically states on the agreement that you need to declare if the employment is in a probationary period.

    We always start people on probationary periods and never sacked anyone during that time. It was reasonable to assume that if your OH was doing a job suited to him that he would stay in that employment.

    As long as you haven't done anything to deceive the finance company and complied with the terms of their offer of an agreement, then you shouldn't have a problem.
