Dear All,
My mother-in-law buried her husband this week, we have been trying to sort the finances out!. We have come across a credit card bill capital one,my mother-in-law has no money to pay this off in large chunks and can only really make small token regular payments. Well the debt has madeits way to a firm of baliffs, also capital one keep ringing her harrassing her saying if she can pay a big chunk off they will knock off around £200 and save debt going to baliffs.
Is there anyone we can contact to report this harassement?, she is willing too pay something!
Many thanks
Jason

Yes the debts are in MIL name and not late husbands.0

Phone or get her to phone CCCS or payplan. They can set up a DMP for her and get Capital One off her case.
Thanks to MSE, I am mortgage free!

Yes you can report the harrassment - to the Office of Fair Trading and your local trading standards office. There's more information and a link to a specific complaint form on http://www.wongawallah.co.uk/debt4.php. That page also should give a good idea of what they can and can't do, what's a bluff and how to deal with it.

she needs to draw up SOA so she can show it to her creditors and demonstrate that she is paying as much as she can afford.
Have these debt had CCJs? Did she go to court and produce an SOA for the judge to decide repayment schedule.
Best if you get her to post a SOA and state exactly the situation for each debt i.e. amount of debt, original creditor , is there a CCJ, did she submit a SOA, who is the debt with now
does she have any assetts for her husband.0 -
tell her not to worry firstly -the creditors talk all sorts of rubbish to scare people into paying more than they can afford. they know that if they take her to court, and she is already paying as much as she can, the court will just side with her. these people take advantage of people's vulnerability. BUT she should not ignore the letters. if she if not on a DMP, she can also speak to the Citizens Advice Bureau. They are very good. CCCS and Payplan, as someone suggested earlier, are good alternatives too. All these comapnies/orgs are free of charge. If she is having financial probs, make sure she doesn't go to a company that will con her into paying more money to "sort" out her debt.I'm moving on up now,

Hi there. Just wondering if she is only in financial trouble until the will is sorted out? Will there be any money coming from her husbands estate?
Sorry to hear of your loss, and it is worse that these vultures circle when people are at their most vulnerable
