reporting a car finance company

:confused: HI COULD ANYONE OUT THERE SUPPLY ME WITH SOME INFO? i have asked a car finance company for a list of charges that i paid to them over the time that ive had finance with them. after 3 weeks ive heard nothing. Should i allow them 40 days ( same period as asking for list of bank charges) ???? and could i report them to the information commissioner,(again, same as you could to banks ) if they fail to reply after this time. thanks,:confused: Geoff

    Are these charges excess fees because you were late or missed payments?
    Did you pay the statutory fee of £10 to get the information?

    Yes you have to wait the 40 days.

    Please answer the above points before I can advise whether to report to Information Commissioner.

    Hi , these payments are by direct debit,and the majority of the charges £26, were for late payments,1 or 2 days late,because the bank have been taking their charges first. i have sent a cheque for £10, but being a finance company ,i wasnt to sure if i could claim these charges back, i thought that maybe reclaiming only applied to banks and credit card companies

    For a running credit account the duty to provide a statement of account upon request is governed under S.77 / S.78 of the consumer credit act 1974.

    The creditor will have 28 days to respond to your request.


    If this approach fails then you will need to consider the full subject access request under the data protection act which is prescribed as a 40 days response time.


    With regards to the fee’s, then yes if they do not reflect a true pre-estimate of loss to the other party then they are unlawful
