I have recently applied for a refund of my PPI for a Capital One account. Filled in all the forms and sent them all the documention and surprise surprise was turned down.
I then went to the Ombudsman. He had produced a copy of my original form which clearly states that I did not want PPI, I only had a original credit limit of £200 and was earning £50k so didn't need it. However, Capital One have produced a copy of the 'script' that should be used when I phoned up to activate the card. In this script is a 'sell, sell, sell' process. I do not remember any of this and Capital One cannot product an actual recording of the actual call or even a transcript of the call. The ombudsman have sided with Capital one saying they are happy that the script was followed and therefore I have agreed to the charges.
This is simply not fair and not just and cannot understand how this can stand up in any court.
What can I do next? I have hard evidence that I originally said NO to PPI they have a copy of the script that they would have used. Nothing to prove that it was used.......Grrrrrr

Sorry to hear this but if this decision was made by the first adjudicator, your able to ask for a review by the ombudsman himself, if you can provide any further information, they will take it into account when reviewed.
Does it state anything on the letter about having it reviewed by the ombudsman?
If not that this is only the first decision, I could contact them to ask about this, because this is usually standard.

Hello,
I had the same thing with Cap 1 , they said I agreed to PPI when the card was activated and I know this was not the case. I went to the FOS last year , I had to provide evidence from NI that I was unemployed when I activated the card therefor PPI was useless. The FOS upheld my claim last month but I am still waiting for CAP 1 who have agreed to settle.
I would go to the FOS , I know this has happened to others with Cap 1 and although the FOS process takes a while ( mine went in last July ) it is worthwhile .
