Prove It letters sent, got a response !

I recently sent off a couple of prove it letters from the template and have recieved one back. Could anyone tell me if the attached doc could link me in any way to the outstanding debt and if so would it be Statute Barred as the date is from 2003

    This is not relevent to the Statute of Limitations.

    When did you last pay or make written acknowledgement of the debt? The prove it letter is not written acknowledgement.

    Statute barred is from 6 years (5 in Scotland) after the date you last paid or acknowledged the debt , so as that date could be anything can you give further info ?
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    As far as im aware the last letter i got was more than 6 years ago, although i cannot be 100 per cent sure. Would it be too harmful to send a statute barred template to them

    Nope. And I don't know what the heck they think that pathetic excuse for a letter proves, but I would send back another demand for proof...you know, the type that actually has some information on it, not the blank they use for printing on.

    Hi all

    Thanks for the replies. I have sent off another prove it letter but in the meantime Robinson Way have started calling, they caught me a bit off guard and were very pushy, i told them that i would be sorting the debt out by letter, would this be enough to connect me to the debt, i know they monitor the calls

    What exactly are you trying to do ?
    If your debt is statute barred, they will know and wont go away if you prove it, they are stale debt sharks and at the moment you are playing the game according to the plan, they have a live fish in the bag here now.
    Statute barred does not mean that they can not ask you to make some payments, just that that you would have a defence against court proceedings.

    So even if they cant prove it and the debt is statute barred they are still free to call and harass you day and night

    When they last wrote to you has nothing to do with it. You need to work out when you last made a payment, or acknowledged the debt in writing.

    Until you are 100% sure, I would not recommend that you insist that it's statute barred. In the very remote possibility that they start a court claim, you would then put in a defence and they would have to disprove you at that point.

    Once you are sure, send the SB letter and they must cease collection activity under OFT guidelines.

    I guess im going to have to chance it as im not 100 per cent sure. i dont think i have made contact in the last 6 years

    No, they absolutely don't have the right to harrass you. Send a letter, recorded delivery from two starting points so they can't say they didn't get it. Tell them that you have no knowledge of this debt and so far theynhave failed to prove otherwise. You do not acknowledge it. Your have written to them giving them final warning if you intention to report them to the OFT for harassment. All contact will cease immediately and you will no longer accept anything other than written correspondence....or words to that effect. I'm in a hurry this mornign so can't write something more cutting at the moment, but you get the idea.

    Now, change your number and ignore. If you are sure this is statute barred you could throw that in to the letter as well...something along the lines of...all debts you were aware of were settled more than 6 years ago etc...
