    My brain is frazzled at the minute, would anyone be kind enough to help me compose a letter to send to Cahoot's complaints dept to get a final response from them so I can go to the FOS/ICO.

    Am slowly losing the will to live with them so far.

    Sorry but I don't think we're getting the full picture here.

    Well you ring up and go through the security checks and then when they ask you how they can help you say "I have no further use for this account, and wish to close it". They then try and talk you into staying, you hold your ground. They then check your account and then relinquish and say we will close the account in so many days. That's it.

    If you think banks run flawlessly then your seriously misguided. I had an issue with a telephone banking bank once, you know the ones who say all calls are recorded for training purposes? Well I had an indiscrepancy with this bank and asked them to play a recent recording back to prove I had made a request for something to be done. And amazingly the recording was of poor quality and they wouldn't let me listen to it.

    Well Santander have finally responded and they say I owe the money, statements from 2005 show this. They say they have sent statements and letters chasing it up. Were they sent them I don't know? They have offered to waiver all the interest charges.

    Where do I go from here? If I take it up with the FSA/ICO how long roughly does it take to resolve? Or if I pay it what happens to the default on my account?

    Previous response proved you are dealing with a bunch of complete morons, so not really that surprised at that one.

    Paying it would not remove the default. If the debt did exist, it's likely statute bared as well.

    Complain to the FOS and ICO. Hard to say how long it will take.

    I would give them one more reply saying that as they say the debt is from 2005 and you closed the account in 2003, you will be forwarding that as further evidence to the ICO and FOS that they are recording a false recent default on your credit report in breach of the Data protection Act. And that you will be seeking compensation for this. And that even if owed, which you deny, this debt would be statute barred.
