How do i know if i have a BRO/BRU

Hi,
I'm due to be automatically discharged on the 11/4/12 after my year of BR.
I was asked to attend a second interview about 2 months ago, the OR wanted to ask a few question about my spending prior to my BR, and was told i may possibly get a BRO/BRU.
I was honest with the OR and answered all question fully, and after the interview the OR said it was 50/50 if i was to get a BRO/BRU.
It is now the 6/4/12 and i still havent heard anything
Do they leave it to the last minute to let you know?
How do they let you know?, is it by recorded delivery?
Surely if i havent heard anything by the 11th i could simply go and start a company, apply for credit, all the stuff that would be banned under a BRO/BRU.
Anyones experience of how they found out they had a BRO/BRU would be useful

    Hi adampeter and Welcome to the BR board. The OR should have sent you a letter to accept a BRU first.

    Have a look on the IS site first, it should confirm your status on whether a BRO/BRU have been put in place.

    So do you think i should have heard by now?, or can they offer me a BRU on the 11th?,
    And do they send their letters recorded delivery for BRO/BRU notifications?

    Yes you should of heard by now and no they don't send by recorded delivery.

    Yes, it says my AD is 11/4/12, and doesnt mention a BRO/BRU,
    I just have a feeling that the OR will try and get me before the 11th
    I assume as long as they apply before the 11th for a BRO its still stands

    There is not enough time now to receive a BRO/U. The OR would have to send you a letter asking you to agree to this, you then you sign and return, then the BRO becomes a BRU, it is then sent to the secretary of state to stamp and sign.

    I would check this IS site on the 11th and if you are discharged then that it it, no BRU/BRO can be given after you are discharged.

    So the BRO has to be in place before AD?
    Or do they apply for the BRO/BRU after they have written to you and this has to be in place before AD?
    Or can they skip the offer of a BRU and go straight to a BRO without asking?

    They should offer a BRU first, but it's hard as I don't know all the facts of your BR


    When can the official receiver apply for a BRO?

    The official receiver must apply to court for a BRO within 12 months of the bankruptcy order being made, although they can ask the court for permission to apply later.
    If the discharge of your bankruptcy is suspended, the 12-month period for making the BRO application will stop running while the discharge is suspended. (Example: Mr A’s bankruptcy order is dated 1 February 2010. The 12-month period during which the official receiver could apply for a BRO would end on 31 January 2011. But, if Mr A’s automatic discharge from bankruptcy was suspended between 1 March 2010 and 1 July 2010, so extending his bankruptcy by 4 months, the official receiver would have an extra 4 months to apply for a BRO, i.e. up to 31 May 2011).
    If the official receiver thinks it right to do so, they can apply to the court for an interim BRO, i.e. before the court hears the BRO application. If granted, its restrictions will apply from the date of the interim order until the court considers the application for a BRO. The court will grant an interim BRO if the BRO application is likely to succeed and it is in the public interest to make an interim BRO. An interim BRO has the same effect as a BRO.

    Just to let you know, i didnt get a BRO/BRU, and im fully discharged from midnight tonight :)
