Welcome Finance, PPI Reclaim & CCJ

Hello,

Can anyone please assist me?

A few years ago I foolishly took out a loan agreement with Welcome Finance.

I successfully claimed a PPI refund but to my shock, I later discovered that they had registered a CCJ against me.

I was under the impression that the actual claim had been paid off against my default notices and would settle the balance.

I have written to WF several times since but they have ignored me.

Where do I stand on this legally?

Any feedback would be great!

    Have you got a copy of the judgement?

    Have you got something in writing that states how much the PPI refund was and a statement to show that it paid off the debt?

    When was the date of the CCJ?
    When was the date of any letters confirming they will refund the PPI?

    Did you not reply to the court papers they sent you? did they have your correct address?

    I take it you failed to maintain the payments for your loan?

    What made you think the PPI refund would clear the arrears?

    The CCJ isn't such a bad thing, the debt should be fixed (in the CCJ) so no longer has charges being added, this gives a fixed sum to aim at clearing.

    I can't believe anyone with a Welcome Finance loan isn't already in a 6yr countdown for all the other defaulted accounts they have. :)

    I also took out a loan about 8/9 year ago with Welcome Finance which i paid off, a long time ago... (Stupid i Know but i was young? naive at the time)
    I was hoping there might be a chance of reclaiming PPi only i have no idea of how to start as i don't have any paper work anymore, but i do have bank statements to prove i had the loan, i have never reclaimed anything before and was hoping for somebody to give me some advice on how to get the ball rolling with little information? and where to send to? as the Welcome Finance Office i went to Isnt around anymore?

    Have a read of the step by step guide to reclaiming on the PPI reclaim section of the forum - PPI Reclaiming Guide: £1,000s for missold loan insurance

    and if you then have questions its best to post on that section of the forum.

    I had no idea what to do either, my loan is still active but shouldnt make a difference to you. Just send the letter in the PPI section of this wicked website that requests details of your loan (I had nothing apart from a yearly statement - stupidly lost the agreement and everything else when we moved).

    Pop a £1 payment in and they send you your agreement. Then you can go ahead with the next letter and start a claim! I just had 2k knocked off my loan which means I only have a year left of repayments!!!

    Hi, I am in exactly same position as you & I want to try & reclaim back my PPI but don't know where to start? I have looked at MSE PPI section however I have no details other than the address of the branch I took out the loan so don't know where to start? Any advice would grately appreciated.

    If you read the step by step guide (link I posted in #7) you will see it covers the situation when a person has no paperwork or account numner and what you should do - look at the section that titled
    "I don't have full details, what can I do?"


    You will see sections such as
    I don't have the paperwork or terms, what do I need?

    It's easier if you have the original loan agreement and terms - though it isn't always necessary. Contact your lender to ask for a copy. Ensure the terms date back to the time of your agreement as these change over time.
    Under the Consumer Credit Act, if you're account's still open you've a legal right to get your agreement from the lender for £1. You could include a £1 cheque to speed it up (don't send cash). If the account's closed, use this template letter to ask for a full account breakdown (can be £10).
    If you aren't sure if you had PPI, check the breakdown of your account for a one-off or monthly insurance payment, eg, 'payment cover', 'protection plan', 'loan protection' or 'loan care'.

    What they need's likely to depend on how old your policy is. Some lenders only need a name and address, others may need more details – check with yours.
    If you’re still a customer, all companies should be able to find your account details from your name and address. If your account’s closed and they can’t find your policy terms it'll be harder to process your complaint.
    Contact your provider with as much detail as you can, or request a full breakdown of your account (this can cost £10). Take your case to the Ombudsman if you’re not happy with the help it gives.

    just to clear up a little confusion..
    i fill in the Questionaire form???(ppi section) Pop in a £1 Cheque??? then Post both to the above address????? and then i can start a claim after???
