Working Over Contracted Hours - Advice Needed

Hi,

I just want a abit of advice regarding my work situation.

Im a care assistant doing night shifts (on minimum wage. I dont get night shift allowance). My employer has contracted me to 48hrs a week (4 x 12hr night shifts a week 8pm till 8am)

This week ive worked my 48hrs plus I did a extra night shift last night (over time) for them as they are short staffed. So this week ive worked 60hrs in total. They asked me to come in tonight aswell, but I said I couldnt due to already having plans this weekend.

I was just wondering if I work more then my contracted 48hrs a week, am i entitled to overtime pay rate instead of my basic hourly pay rate? or is it just down to my employers discretion?

Also, what's the law regarding how many hours maximum you can work a week?

Any advice would be really appreciated :)

    Surely you would be paid overtime.

    Would you work extra shifts for no pay and if so..why?

    I will get paid for the extra shift I did last night but I believe its just my normal hourly rate (minimum wage) Should I be getting over time rate beings its over my contracted hours?

    might be worth checking your holidays.

    if contracte to 4* 12hr per week then you are entitled to a minimum of 5.6 weeks so 22.4 days paid at the 12hr rate.

    It depends on your contract of employment, I work as a nurse for an NHS Trust on agenda for change, obviously I am paid more than NMW however, our Trust to save money are wanting to put people on a new casual workers contract to bypass AfC T&C's which state overtime will be paid at time and a half, the new casual workers contract will only pay the bottom of band 5 which is around £10 per hour for any overtime hours worked and that is for anyone of Band 5 or 6, so consequently they are asking most of us to work overtime for an hourly rate much less than we already are on. If we refuse to sign this new contract then we won't be able to do any overtime (suits me fine!)

    So, there is no 'law' that you have to be paid overtime rates for extra hours worked, it all depends on what locally your contract states about overtime pay
