Letter out of the blue from Mackenzie Hall

Hi all,
Just wondering if someone could give me some advice?
Have been wading through the masses of info on the internet but cant find quite the same scenario to match mine up with.

Last week my partner received a letter from Mackenzie Hall (which from what I have read about them on here - isn't great) Saying that they needed to get in touch with him about a personal matter. He ended up ringing them unfortunately and they have come up with some debt that he apparently owes on a phone contract with o2 through carphone warehouse back from 2007.
He says he doesn't remember this at all, doesn't ever remember being with o2, but there was a lot going on at that time in his life, his dad had died and his mum was relying on him a lot for money, so it could be the case that this has slipped his mind, or he took it out for his mum etc.
This is the first time he has received anything through about this though and it seems odd that it has just popped up from no where.
He spoke to them again and says he still isn't aware of this debt, but they just say it is his and he needs to pay it. So he has had to submit an income and expenditure form, as we have no spare money at all.

Should they be showing him something to prove this is his debt? Because from what i have read about them they seem to just pick a name and find an address for anyone with the same name?

The reason I have doubts about this is there is no trace of this debt on his credit record. Everything on there we can account for, and are currently paying.

Anyone any ideas what we should do? Just to add, we live in Scotland if this makes any difference?

Thanks :)

Yes, do not fill in any forms ! or sign anything, they get a copy of a wet signature and it is game over.

Now, secondly, nobody forgets signing a contract, EVER.

So some truth might help the situation:
    Write back with the following
REF: Attempt to obtain joinder with o2 debt and named recipient of letter.
As you may be aware before joinder can be created with the said debt to o2 you must first provide some form of proof that this debt is owed by the person you seek to obtain joinder with, therefore I Demand that any information you hold that you have used to obtain such conclusion be copied and forwarded along with a copy of any contract or credit agreement.
In absence of such material I will be unable to enter in to any further correspondence whatsoever and will regard the matter closed and for record purposes the refusal to provide the required information shall remain on record to be used in defence of any legal proceedings.
    I await the information.

  • Thank you, I will do this in the morning.
I am just not convinced at all that this is his debt. He had said to them if he was to pay anything it would only be £5 per month, but I don't want to be paying anything until I know it is his.
    Thanks a lot :)

Don't talk to them on the phone.

Don't send anything except maybe a prove-it. Certainly don't send an income/expenditure statement.

Being in Scotland does make a difference because, if this was your debt, it becomes statute barred after five years, not six as in England/Wales.
