    yeah I kind of thought about that too.. but how would I know for certain? am sure I cant just leave it and wait for them to maybe claim it back?

    Nope it does not clarify anything at all..

    Any ideas?

    HMRC have! Little option but to contact them if it's not obvious from what you have?
    If you want to test the depth of the water .........don't use both feet !

    Yeah fair point.

    I shall debate for a while and probably leave it... do you know if they would contact me again - if they decide to start taking money?

    Depends on what they've already sent you? If they've asked for the money (voluntarily) from some time ago - then they may send you an SA Return to complete for 07-08. Which involves penalties if you don't complete it and interest on the money if you do.

    So clarifying the situation makes sense? From what you've previously said - it looks as though they have conceded 07-08.
    If you want to test the depth of the water .........don't use both feet !

    Still awaiting a response to my complaint letter sent special delivery on the 13th April. In the meantime I am being hassled by them for DD details for monthly repayments. Yesterday received a letter from Glasgow branch saying if I did not contact them within 14 days they would send the debt collectors blah blah..... I’m reluctant to do anything at the moment as I believe I have a strong case and will go all the way to the adjudicator if necessary. Should they be chasing payment in the midst of a formal complaint?Thanks.

    Given it's less than a month, they probably won't have dealt with your formal complaint so the collection department won't know about it. Best thing is to phone the collection dept and tell them there's an appeal/complaint in process. Unfortunately, this kind of thing happens a lot because HMRC are so slow in dealing with letter written to them.

    OK - I will call them and explain. BTW what is the typical wait time for a response to a complaint? if they have not responded within a certain time frame should I send another letter or phone them? thanks.

    It varies from 4 weeks to 8 weeks or more. A couple of times I have been on the verge of complaining about the complaint when the letter has arrived!

    The current response time for formal complaints is 45 working days.
