New Buy Mortgage scheme help please

I wonder if anyone can help answer this question.

I have recently attempted to purchase a new home under the new buy mortgage scheme recently released by the government.

This allows for people to get on the housing ladder with 5% deposit, new homes only.

Reading on this site it relies on the builders putting 3.5% of the purchase price into the scheme per home.

In my case i need to understand if this should be paid by the builder or buy the customer (me)

in my case I have seen a property for £240,000 yet the building company have told me I have to sign for £249,000 as its a new buy scheme, hence charging me £9000.

Should they be passing on this charge to the buyer?
