getting letters for my ex's unpaid bills!

In the past my husband has had a few letters from companies unable to get payment for bills at his old address because his ex isnt paying as shes still living there. When they get no joy from her they seem to be tracking him down as I assume they find him linked to the address somehow.

We have always dealt with it by contacting the companies and proving he hasnt lived there for years but another one has just come through for a phone bill.

How can we stop this for the future. Can we somehow remove the link to him from the address ?

Appreciate your advice!

thanks

Are these accounts all just in his ex's name? not in his name?
Eg the phone bill is addressed to her not him and her. Or are they writing letters addressed to him at your address?

You cannot remove the link to the address if it was a genuine address of his.
Did he ever have any joint accounts with her? are these all now closed? He might want to check on his credit reports to see if she is down as a financial associate - and if she is to file a notice of disassociation.

  • Hi,

I think it might be a bit of both. One came through for a card he didnt even know about so it must have been something she had arranged, although the letter chasing payment was address soley to him.

The utility bills however, he thinks may have been joint accounts but she hasnt updated them into her name.

I assume the only way around this is to get a credit report done to see who he is 'in debt' with. That wouldnt show accounts in his name that are being paid though would it?

    Thanks

Your OH needs to start sorting this out. it is his responsibility to take his name off, not hers to remove it.

Firstly, list all utilities and ring them and tell them when he moved out and that the bills are in her name only after that date.

    Secondly, get his credit records.

He needs to get any joint accounts closed if possible. If not, he needs to insist that any future debits need both signatures. He is jointly and severally liable for these debts - she can run up the debt and he has to pay the whole lot off not just his "half".

With respect to all these, it is in her interest to get them sorted as well; Councils and benefits are cross referencing credit records and benefit claims now. She could lose her single person's claim for CT for instance or any claims for working or child tax credit and face reclaims unless she can prove they are not a couple. Much better to remove his name from the accounts.

If he has accounts in his sole name still going to his old address, he needs to inform that creditor of the new address or arrange to forward mail via the Post Office.

If she has opened new accounts in his name, he needs to speak to CIFAS and to the credit reference agencies as well as the creditor.
