Hi everyone, hoping someone can help.
I have a CCJ for just over £4000 regarding Car Finance i took out in 2003. This is with DLC. I started paying this off but then got into financial difficulty, which resulted in me unable to afford payments. In October 2011 i was issued with a warrant of execution, so i went to the court office, paid the £40 fee and agreed a payment of £50 per month, as that is all i could afford.
Now i have lost my job and am unable to afford anything close to the £50 for the time being. What i would like to know is what would happen if i just stopped payments? I have nothing of value for bailiffs to take as i live at home with my mum. Can i just write to DLC, explain my circumstances and offer a token payment until i find another job? There's just no way i can afford anything at the moment

I'd be extremely careful about just stopping payments. Contact DLC and send them a breakdown of your current income and outgiongs (include things like rent to your mum, etc) and offer what you can realistically afford.
When Bailiffs come knocking, they can be nasty pieces of work and say you're not in and your mum answers? Not nice!!! Plus, you would need to prove that your mums possessions don't belong to you.0 -

My mum knows about the debt but is in no position to help. I'm currently out of work so will write to DLC and explain my situation. This months payment is due out on the 1st April but i can't afford it, should i cancel the direct debit and see what they come back with regarding my letter?0 -

I'm not sure how things work if you've agreed the £50/m with the court though because I've not been in that position but if DLC want their money they're gonna have to play ball.0 -
If you can't afford it then I would cancel the DD (if you are in time to do so, it may be they've already requested the payment by now?) and pay them a reduced payment by some alternative method
I would write to them and explain your circumstances. If they won't agree to the reduction in payment then you may need go back to court to apply for a redetermination based on your new situation.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

I haven't got the original document i signed, no. I gave them the car back in 2006 as i couldn't keep up with repayments plus insurance etc. I've payed about £400 of it off so far.
I've just cancelled the direct debit and will write them a letter offering a token payment until i can afford more.
If i haven't got it, they can't have it can they0 -
how much did they write off when you handed the car back?0
