Hi I am fulltime employed and working split shifts in the domicillary care profession. I am contracted to do 35 hours a week monday to friday and work some days from 7 through till 10 at night. With breaks in between the day, for instance maybe a hour and a half break somewhere through the day and the finish at 10 that night to be back at work the following morning at 8. Is that legal? Mondays 7 - 22. Tuesdays 8 - 22. Wednesday 8 - 22. Thursdays 8 - 6. Fridays 7 - 6. I'm always feeling tired. Anyone out there with some sound advice for me? Thank you

It appears that in most cases you should be getting 11hrs between shifts
http://www.direct.gov.uk/en/Employment/Employees/WorkingHoursAndTimeOff/DG_10029451I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
I think working in care means that it comes under the 'round the clock staffing' exception to the normal rest breaks.
So compensatory rest of at least 90 hours a week must apply. You'd have to be working over 78 hours a week to be breaking that.
The details are further down the same link as the above post.0
