Who is legally at fault here, the neighbour, or the person asked to cut 12" off it?

we had some really high conifers that I assume previous owners had planted in front of a large grass verge , we had put fencing in front of it . The council removed them last year and its really spoilt our garden. However they had got very tall and were unsafe

Just got back from the school run, the neighbour is sunning herself in her garden, same as the neighbour next door to her, who also has the original height hedge in her garden, there is no difference in the amount of sunlight in either garden. The way the garden faces makes a huge difference.

Yes they weren't allowed and if the sale fell through, you could no doubt have taken then to a small claims court.

Excuse me for somewhat sidetracking this thread but to respond to this - the people turned out to be obnoxious little gits who we decided we would not inflict on the lovely neighbours who had cared for our mum through some very hard times.
Some things are more important in life than money.
To get back on track - nice garden OP. Mine is the size of a postage stamp!! I long for a bigger garden!Less stuff, more life, love, laughter and cats!

the neigbour should have been a bit more crafty about it and given the hedge a salt water drink every night for a few weeks and got rid of it properly. With the added benefit of the fact there is no law to stop you pouring salt and boiling water into your own soil.
It's not their soil though is it ? The trees are on my land.0 -
I wouldn't want to be living next door to you either if you cant see why a hedge that size is inappropriate.
BTW you wouldn't need to go onto your soil to poison it with salt. It could be poured on their boundary and the root system would soak it up. Might take a bit longer than if you could pour it directly on the roots but you would have the same end result.0 -
Goodness whatever happening to good old 'having a chat about the hedge with the neighours' - or even a note through the door - I'm glad I dont live next to some of you lot.:eek: And yes, I'm sure you are glad you don't live next to me....for whatever reason you wish.....Less stuff, more life, love, laughter and cats!

Please no. No more laws telling us what we can't do in our own homes. You're never going to stop the occasional disagreement, but that's no good reason to turn to the courts for the answers to everything.
To the OP: If you don't know for sure exactly what type of conifer it is, it would be worth getting an expert's view on it. Contrary to popular opinion, some conifers will re-grow from lower limbs if chopped.
I'm not an expert, but the tree surgeon who came to look at mine told me that Leylandii generally don't, Lawson's Cypress do, but to a limited extent, and Thujas generally do.
While we have anti social behaviour we will need laws to combat it, someone apparently has a hedge over 10 foot high which doesn't cause any shade in their neighbours garden, hows that for one eyed logic?:T0 -

I get shade in another part of my garden from another neighbours hedge. I'm not about to go and cut it down, it's the way it is, i accept it. Should i be given an asbo ? Am i the one who has caused criminal damage to someones property ?
As i've said before, this isn't about whether i should have a hedge the height it is, it's about how my neighbours have acted.0 -

Perhaps your garden is big enough to cope with shade. Perhaps you can sit someone in the sunshine. Perhaps your neighbours cant.

If your neighbour took the law into their own hands by going out of the way to cut a hedge down then I am guessing that it was inconveniencing them to a great extent.0
