Tribunal at work, where do I stand benefit wise???

They have not given me a date yet but they have told me between july 07 - august 07 before it goes to tribunal, have just had my compnies side of it and it is unbelievable!!!! Was swearing at the statement as i read it and was straight on the phone to my solicitor who was actually laughing at what they have said about me. Am so skint that I am gonna have to disregard sick note and find a new job!
the thing is tho Jem, you cant claim constructive if you are still working there AFAIK. My understanding is that in order to claim constructive you have to have felt there is NO OTHER OPTION but leaving, as they have made it untenable for you to work there.
I would draft up your resignation asap, stating that the racism youve experienced is the reason you can no longer work there and your GP agrees, hence they have signed you off.
Apply immieidaltly for JSA and everything else. You can then get a social fund loan to tide you over.
Are you a member of a trade union, only they have cash pots ( I had a few hundred out of them when going through my own claim for constructive) Do look into this if you can:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Had a meeting with solicitor today who has advised me to draft resignation and claim constructive dismisal and let him check it over before i send it, sick not has run out today but I am trying to send as many cvs as possible, am probably not going to bother with sick note renewal as dr cant see me untill earliest of wednesday to re new it, I joined a union after things got difficult at work so am not covered with these events pffft!:mad: I'll get you debts and your little dog too!!! :mad:And best of luck to all the other debt busters out there!!:beer:0

That may not be the case, ask you may find that it's not an issue.We will provide representation once a membership form has been completed and returned to a steward, the only exceptions would be entitlement to rule book benefits which would have a three month qualifying period.Don’t be a can’t, be a can.0 -
I've only just read your query and all the previous replies. Hope you've given up the job and got something sorted. If you gave up your job and made a claim for Income Support hopefully they've sorted your benefit out by now. Your benefit should not be affected by leaving your job as you're a single parent and not required to look for work. The same applies to incapacity benefits. You certainly should hold on to all paperwork and carry on with the tribunal. No-one should put up with such abuse.:hello:0

Had 4 job interviews so far this week, no offers as yet. Still awaiting housing benefit and in serious debt with all friends and family. Have 1 more week off sick so have told everyon I have to give 1 weeks notice so hopefully I will get some job offers today and can send letter to solicitor so we can claim constructive dismisal and I wont have to worry too much about it when in shiny new anti racism job. Will keep you all updated on whats happening, court date is 20 - 21 August so have a bit of a wait yet and as far as I know they havent even had any legal advice yet. The good bit of it all is I have had their statement of events thru and it is the biggest load of bull!!! Good thing they havent seen my evidence yet or they would be bricking it!!! If you have fibro you should be claiming DLA as it is now classed as a recognised disabillity. Phone up for a claim pack and get it sent off as they will back date the claim from the day to asked for the pack is which usually approx 3 months. .
Warning
It is very difficult to get DLA for ME and Fibro as they are fluctuating conditions. If you can find someone local with fibro who claims DLA then get them to help with the form. Don't want to put a damper on things but most DLA claimats with fibro gets turned down or goes to appeal, sometimes even tribunal.The "Bloodlust" Clique - Morally equal to all. Member 10
