Please can someone advise me .. I have worked for the same company for 8 years, 4 years ago I transfered to a different branch, doing a different job, when I was interviewed for this role I was told that the rate of pay was about 50p per hour less than I had been getting but they would make the money up as as an additional payment under the heading "other pay" . This has been paid to me for the last four years with no problem.
We now have a new manager who has refused to make this extra payment, because he says it is not in my contract, I explained that I would not of transfered from my previous role if the money had been less than I was getting, but he has already stopped this payment. It is making a difference of about £90 a month, and I cant afford to loose this money.
The manager has told me to put in a grievance to the company and they will look at it, But can anyone tell me if I have a case to get this payment reinstated. Thanks for your time.

What did HR say when you spoke to them about it?If you haven't got it - please don't flaunt it. TIA.0

I think there is a term in contract lawcalled assumed acceptance which after 4 years they would have no grounds to ignore legally.
You need to do some research but after having paid you that for 4 years, if my memory is correct about the term they'd find it hard to justify removing it from you in the eyes of the law.
You need to seek expert advice though.0 -

Sorry - for a bit of reassurance - if the payment was truly "wrong" then they would be looking to reclaim the four years of "overpayment".
They clearly aren't going to do this....that would be mad! But it's a good test to prove that the payment is contractual.
So they have 2 options - continue with the payment or give you 12 weeks notice of the change.
obvs. don't tell them this.
Just raise the grievance....0 -
Thankyou everyone ror your replies. I have not spoken to HR about this poblem as yet, I didnt know what to do for the best. I thought that I had read somewhere that after a period of time, any change to my contract (Undisputed) couldnt be taken away again.
Can anyone direct me to a template for a grievance letter, I havent got a clue of what I am supposed to write.
Sorry to be so clueless, but I have never had to deal with anything like this before, and workmates seem to think I should just accept the change with no complaints.0 -
Call your HR. E-mail and letters don't get things done. They might resolve this there and then for you.0
