RBS Debt Guidance

Good day one and all,

I've spent some time lurking in the background and seen the great help that this community can provide.

So I'm hoping that someone may be able to help me with an issue I have.

In late 2004 I opened an RBS student account with the maximum overdraft as I was planing to go to university and the money was going to help with my tuition.

As I was a foreign student, tuition fees were pretty hefty and every penny was going to help. Unfortunately I never ended up venturing to university as I just could not raise the money.

But I still had the account. I never actually used it, it just sat around as I was to lazy to close it. There did come a time though were my mother was struggling and as my elder siblings which were living with her and meant to be helping her financially did not. So she needed money in order to pay rent or face been kicked out. That was my overdraft with the promise of the elder siblings paying it back.

So I agreed stupidly and never thought much about it. Unfortunately it was never repaid and it defaulted some time in 2007.

I myself could not afford to pay it once I found out it was needing payed as I was living by myself getting a train to work on very minimal wage. Now though, I am in a much better place and married and want to set this straight.

I have letters from RBS collection, TDM, APEX etc. And I've been on the phone with all of them to no avail. None of them can find my account via reference numbers on the letters or my actual account details from RBS.

So where does this leave me?

Understandably it should never have defaulted, but on the other hand it is a mark on my history I can not satisfy if they can not find it.

(I have looked at my credit history via a few sites and the debt is registered still as been provided by RBS Current Accounts. So I'd imagine the debt is still in their hands.)

I'm usure of how to proceed from this point and would like any pointers that you could provide.

    How recently did you last have a letter about the debt?

    Did you get copies of your credit files only recently? If so its possible that that will trigger someone maybe a new debt collector to chase you (as you'll have provided or confirmed your current address).

    If you don't and you wanted you could write to RBS and ask them to provide information on it. If they are still responsible for reporting (assuming their entry doesn't show settled on your credit file) then they will know who is chasing now or even who owns it if its not them - as if you paid the relevant debt collector RBS will have to update your file.

    In terms of this debt - if you decide not to try chasing it and tracking it down and if you are not chased - it would become statute barred 6years after the date the overdraft was officially recalled by the bank - which is likely sometime not long before the default.

    I agree with Tixy by the sounds of it the debt is very close to becoming statue barred so I wouldn't not attempt to contact anyone just yet.

    However just for information purposes the Client Reference on the Apex letter is actually your sort code and account number joined together (unless they have changed the formatting of there letters).

    The account defaulted 31/10/2007 apparently. So I'd imagine that would mean it's been reported until October 2013.

    I've been in contact with each company from each letter. RBS Collections, TDM, Apex and they all went away to check and all responded with the fact they couldn't find it. This was about 3 to 4 months ago.

    All the letters are from 2007, there may have been one from 2008.

    I've called standard RBS and they said that I should go into a branch with the info and have them search. If they couldn't find it I should have it removed.

    Should I just wait it out?

    Normally if the debt is with Apex and they have had issues in contacting you for a considerable amount of time they will pass the debt back to RBS.

    Tixy is a very reliable source of information and may be able to advise you better than myself. Personally I would just wait it out........
