Santander overdraft, cannot get out of it!

Hi, we have an account with Santander, with an agreed £2500 o/d. It currently stands at £2615.26. This is because we no longer use the account, cancelled everything, but somewhere something like £4.50 dd went out, they bounced it, charged for it, and continue to charge for it, at £100 per month.
I wrote nd said we'd fallen on hard times, but if they'd help reduce the charges we could pay £50 per month. This was agreed, they refunded about £300 in charges and said py £50 per month. Great. Except they left the balance at £2515. So still over the o/d limit, so another £100 charge!
I wrote and said look, we will pay £50 per month, but what's the point if your gonna charge £100 per month?!
Today we got the default notice, pay full amount in 14 days or we tke further action, etc etc,
Where do we stand?
Is there anything we can do to stop them going for a ccj now?

    You may find that after a default notice has been issued that they will be more willing to freeze charges going forward.

    They could choose to go for a CCJ, but if they think that you are paying all you can realistically afford to then there is certainly a good chance that they won't bother to take court action.

    Have they replied to your last letter at all? (the default won't be a reply as such it will just automatically happen).
    If you hear nothing back and they still charge you I would write again, set out that you can only afford £50 per month but will increase your payment if your circumstances improve. And ask again for them to freeze interest & charges. They don't have to but they probably will.
    There are some useful templates on the national debtline website you might want to look at for ideas of what to write.
